According to the NY Times, Jason will not be suspended for his foul on Jannero Pargo in Game 4 of the Dallas-Hornets series.

The N.B.A. reviewed Kidd’s flagrant foul Monday morning but determined that no further action was warranted, according to a league spokesman. Kidd was assessed a flagrant foul two on the play, which occurred with 7 minutes 16 seconds left in Sunday night’s game. Kidd was automatically ejected, and the Hornets cruised to a 97-84 victory to take a 3-1 lead in the series. Game 5 will be played Tuesday at the New Orleans Arena.

Kidd said he was only trying to keep Pargo from converting a fast-break layup and did not intend to hurt him. As Pargo pulled up for the shot, Kidd collared him around the shoulder area, then grabbed his neck and appeared to yank him down. Pargo went face-first toward the court, but broke his fall with his hands and arms, and quickly popped back up.

“I just tried to foul Pargo, wasn’t trying to hurt him, and they called a flagrant two,” Kidd said Sunday night.
